PART I – GENERAL TERMS AND CONDITIONS

1. Definitions

  • Account means any wallet account or related account used for the Services.
  • Application means the PAY PLUS mobile application and digital platforms.
  • Services means all services offered by PAY PLUS, including wallet, transfers, FX, cards, payments and related services.
  • Customer means any individual or legal entity using the Services.
  • Card means any physical or virtual card linked to the Wallet.
  • Agent means any authorized PAY PLUS representative, branch, or service location.
  • Applicable Laws means all Lebanese laws, regulations, circulars, directives, sanctions requirements, and regulatory obligations applicable to the Services.

2. Acceptance of Terms

By registering for, accessing, or using the Services, you agree to these Terms and any amendments made from time to time.

3. Regulatory Status

PAY PLUS is licensed and regulated in accordance with applicable Lebanese laws and regulations.

4. Eligibility

Users must meet all legal and regulatory eligibility requirements. PAY PLUS may approve or reject applications at its discretion.

5. Account Registration and KYC

Users must provide accurate and complete information and any documents required for identity verification, AML/CFT compliance, sanctions screening, and regulatory obligations.

6. Customer Obligations

The Customer shall:

  • Provide accurate, complete and updated information
  • Maintain the confidentiality of all security credentials
  • Use the Services only for lawful purposes
  • Comply with all applicable laws and regulations
  • Promptly notify PAY PLUS of any unauthorized activity, suspected fraud, or changes to customer information
  • Cooperate with any compliance, verification, or investigation requests

7. Prohibited Activities

The Services may not be used for:

  • Money laundering or terrorist financing
  • Sanctions evasion
  • Fraud or unauthorized transactions
  • Illegal gambling
  • Illegal goods or services
  • Deceptive or unlawful activities
  • Any activity prohibited under applicable laws or regulatory requirements

PAY PLUS may suspend, reject, block, freeze, or terminate any account or transaction associated with prohibited activities.

8. Privacy and Data Protection

Users consent to the collection, processing, storage, transfer and disclosure of personal information for service delivery, compliance, fraud prevention and legal purposes. Banking secrecy is waived to the extent necessary for the provision of the Services.

9. Electronic Communications

Users agree to receive notices, statements, alerts and disclosures electronically through the application, SMS, email, push notifications or other approved channels.

10. Security and Authentication

Users are responsible for protecting passwords, PINs, OTPs, cards, devices and credentials and must immediately report any unauthorized access.

11. Fees and Charges

Services may be subject to fees, commissions, exchange margins and charges. PAY PLUS may amend fees from time to time.

12. Consumer Protection and Complaints

Customers may submit complaints through designated channels. PAY PLUS will investigate and respond within reasonable timeframes.

13. Intellectual Property

All trademarks, logos, software and content remain the exclusive property of PAY PLUS or its licensors.

14. Third-Party Service Providers

PAY PLUS may use banks, payment processors, card schemes, technology providers and other partners to deliver Services.

15. AML/CFT and Sanctions Compliance

PAY PLUS may monitor, block, delay, reject, investigate or report transactions where required by law or internal policies.

16. Source of Funds and Source of Wealth

The Customer represents and warrants that all funds used in connection with the Services originate from lawful and legitimate sources and are not related to any illegal, fraudulent, money laundering, terrorist financing, sanctions-related, or other unlawful activity.

PAY PLUS may, at any time, request information or supporting documentation relating to the Customer's identity, source of funds, source of wealth, beneficial ownership, business activities, or the purpose of any transaction in order to comply with applicable laws, regulations, and internal compliance requirements.

The Customer undertakes to provide accurate, complete, and up-to-date information and documentation upon request. Failure to provide satisfactory information or documentation may result in the delay, rejection, suspension, restriction, reversal, or cancellation of a transaction, and/or the suspension, limitation, or termination of the Account and Services.

PAY PLUS reserves the right to conduct ongoing due diligence and transaction monitoring throughout the customer relationship and may disclose relevant information to competent authorities, financial institutions, payment service providers, auditors, or other authorized parties where required by law, regulation, or compliance obligations.

PAY PLUS shall not be liable for any loss, delay, or inconvenience resulting from compliance reviews, investigations, verification procedures, or actions taken to comply with applicable legal and regulatory requirements.

17. Dormant Accounts

Accounts may be classified as inactive or dormant and may require re-verification prior to reactivation.

18. Record Retention

PAY PLUS may retain customer and transaction records for the period required by law and regulation.

19. Transaction Monitoring

All transactions are subject to screening, monitoring, fraud detection, sanctions checks and compliance controls.

20. Limitation of Liability

PAY PLUS shall not be liable for indirect, incidental, consequential or punitive damages, system failures, network interruptions, third-party failures, cyber incidents or force majeure events.

21. Indemnification

Users agree to indemnify PAY PLUS against claims, losses, damages and expenses resulting from breaches of these Terms or misuse of the Services.

22. Force Majeure

PAY PLUS shall not be liable for delays or failures resulting from events beyond its reasonable control.

23. Suspension and Termination

PAY PLUS may suspend, restrict or terminate accounts and services for legal, compliance, security, operational or risk-management reasons.

24. Amendments

PAY PLUS may amend these Terms at any time. Continued use constitutes acceptance of the amended Terms.

25. Governing Law and Dispute Resolution

These Terms shall be governed by Lebanese law. Disputes shall first be resolved amicably, then by arbitration in Lebanon. PAY PLUS may also refer disputes to the competent Lebanese courts.

26. Miscellaneous

Assignment, severability, survival, taxes, and independent contractor provisions shall apply.

PART II – PAY PLUS WALLET SERVICES TERMS

1. Wallet Services

The Wallet is an electronic payment account intended for payment transactions and related financial services and is not a savings account.

2. Cash-In Services

Funding may occur through cash deposits, bank transfers, card funding, salary transfers, remittances and other approved methods.

3. Cash-Out Services

Withdrawals may be conducted through agents, branches, partner networks, cards, bank accounts and other authorized channels.

4. Wallet-to-Wallet Transfers

Users may transfer funds to other wallet users subject to limits and compliance checks.

5. Domestic and International Transfers

Transfers may be subject to additional verification, intermediary fees, sanctions screening and regulatory requirements.

6. Foreign Exchange Services

Exchange rates are determined by PAY PLUS and/or its partners and may fluctuate.

7. Merchant Payments

Users may make payments to participating merchants. Merchant services may be suspended where fraud or regulatory concerns arise.

8. QR Payments

Users are responsible for verifying payment details before authorizing QR transactions.

9. Bill Payments and Government Payments

PAY PLUS acts as a payment facilitator and is not responsible for third-party biller errors.

10. Salary Disbursements

Salary and payroll services may be provided subject to separate arrangements and applicable regulations.

11. Payment Links

Users may generate payment links to receive payments. PAY PLUS may review or reject transactions associated with payment links.

12. Card Services

Cards may be issued through NymCard and/or other approved providers. Additional cardholder agreements may apply.

13. Transaction Limits

PAY PLUS may impose daily, monthly, annual or per-transaction limits and amend them at any time.

14. Transaction Finality

The Customer is responsible for verifying all transaction details before authorizing a transaction. Once a transaction has been authorized and processed, it shall be deemed final and irrevocable and may not be cancelled, amended, or reversed except where required by applicable laws, regulatory requirements, card scheme rules, payment network rules, or PAY PLUS policies.

PAY PLUS reserves the right to delay, reject, suspend, reverse, or cancel any transaction where required for compliance, fraud prevention, risk management, operational, security, or legal reasons.

PAY PLUS shall not be liable for losses resulting from incorrect, incomplete, inaccurate, or unauthorized transaction instructions provided by the Customer.

15. Refunds, Reversals and Chargebacks

Refunds, reversals and chargebacks shall be handled according to applicable rules, regulations and internal policies.

16. Unauthorized Transactions

Users must immediately report unauthorized activity. Delayed reporting may affect available remedies.

17. Fraud Prevention

PAY PLUS may suspend accounts, withhold funds or investigate transactions suspected of fraud, abuse, money laundering or unauthorized activity.

18. Agent Network Services

Services may be provided through authorized agents whose availability and liquidity may vary.

19. Safeguarding of Customer Funds

Customer funds shall be safeguarded in accordance with applicable laws and regulations. Funds do not accrue interest unless expressly stated.

20. Service Availability

Services may be interrupted, suspended, upgraded or discontinued at any time.

21. Account Closure

Customers may request account closure subject to settlement of all obligations. PAY PLUS may close accounts in accordance with legal and regulatory requirements.

22. Future Services

PAY PLUS may introduce new products and services, which may be subject to additional terms.

23. Survival

Provisions relating to liability, indemnity, compliance, confidentiality and dispute resolution shall survive termination.
